difference between independent contractor and employees

I'm trying to find out the difference between a real estate agent independent contractors status and employees status. I read the independent contractors vs. Microsoft case, and found out that the contractors won this suit against them in determining their status as an independent contractor. From my research I found that, If the company you work for don't take out federal taxes, social security, and medicare you are considered to be and independent contractor and the only garnishments that can be enforced is IRS collections. Also I found no information about personal garnishments, credit cards, student loans garnishments etc.. being legal in an independent contractors status. How can anyone calculate an real estate agent independent contractors income, when it may be several months before that agent ever gets any kind of commission and this may be the only commission that the agent gets for the rest of the year. How do they survive when the money is already due for state licensing fees, company fees real estate fees etc..

In closing, this is a issue that every real estate agent asks, but some of them have an agreement signed with their firms stating that they are Real Estate Contractors Absolute, which exempts them from any garnishments, so they say. Is it such an agreement? If so how do I find more information about this agreement or how can I have one drawn up for the company that I work under.
