| In <em><u>Heintz v. Jenkins</u></em>, 115 S.Ct. 1489, 131 L.Ed.2d 395 (1995), the United States Supreme Court confirmed that the Fair Debt Collection Practices Act (the "FDCPA"), 15 U.S.C. § 1692 et seq., applies to attorneys who regularly attempt to collect consumer debts. Following <em><u>Heintz</u></em>, courts in an expanding variety of circumstances have found attorneys liable under the FDCPA to the debtors against whom they are pursuing collection efforts. In light of these developments, it has become crucial for all attorneys, even those who only occasionally perform collection work, to gain a working knowledge of the FDCPA, the circumstances that trigger its application, and conduct that the FDCPA proscribes.... |
